English as a Qualifying Factor for Disability?

Did you know if someone does NOT speak English, that could actually be a qualifying factor for whether they’re entitled to receive Social Security Disability Insurance (SSDI) payments?

Let’s take two separate people. Both of them 45 years old with unskilled work experience. In fact, both of them are exactly the same in every respect **except** one of them speaks English while the other does not.

Now let’s say both of them suffer an unfortunate back injury and doctors conclude that going forward, the only work they can do on a full-time basis must be “sedentary.” Under current law, the person who does NOT speak English would likely qualify for disability payments, while the person who speaks English would not.

In other words, everything else being equal, there are certain avenues in our SSDI laws that show preference to people based on the fact they do not speak English. But heaven forbid anyone question the fairness of this...
